01 Privacy Policy (GDPR)
1.1 Data Controller. CreativeBuildWorks, registered at 44143 Paderborner Straße 75, Dortmund, Germany, is the data controller responsible for processing your personal data. You may contact our data protection officer at [email protected].
1.2 Data We Collect. When you submit a contact form or inquiry, we collect your name, email address, phone number (if provided), company name, and any message content you provide. We also collect standard web analytics data including IP address, browser type, and page visit timestamps.
1.3 Purpose of Processing. Your personal data is processed solely for the following purposes: responding to your inquiries and project requests, delivering contracted services, sending transactional communications related to your project, and maintaining compliance with applicable tax and commercial record-keeping regulations.
1.4 Legal Basis. We process your data under Article 6(1)(b) of the GDPR (performance of a contract or pre-contractual measures) and Article 6(1)(f) (legitimate interest in responding to business inquiries). For marketing communications, we rely on your explicit consent under Article 6(1)(a).
1.5 Data Retention. Contact form submissions are retained for 24 months from the date of submission. Contract-related data is retained for the duration of the contractual relationship plus 10 years as required by German commercial law (§ 257 HGB).
1.6 Data Sharing. We do not sell, rent, or trade your personal information to third parties. Data may be shared with essential service providers (hosting, email delivery) who process data on our behalf under strict data processing agreements compliant with Article 28 GDPR.
1.7 Your Rights. Under the GDPR, you have the right to access (Art. 15), rectify (Art. 16), erase (Art. 17), restrict processing (Art. 18), data portability (Art. 20), and object to processing (Art. 21) of your personal data. You also have the right to lodge a complaint with the supervisory authority: Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen.
1.8 International Transfers. Your data is processed within the European Economic Area (EEA). If any data transfer outside the EEA occurs, we ensure appropriate safeguards under Article 46 GDPR, including Standard Contractual Clauses.
02 Terms of Service
2.1 Parties. These Terms of Service constitute a binding agreement between you ("Client") and CreativeBuildWorks, registered at 44143 Paderborner Straße 75, Dortmund, Germany ("Provider"). Contact: [email protected].
2.2 Scope of Services. CreativeBuildWorks provides bespoke web design, creative digital development, brand identity, and related digital services as described in individual project proposals and Statements of Work (SOW). Each SOW, once signed by both parties, becomes an integral part of this agreement.
2.3 Pricing & Payment. All prices quoted are in USD unless otherwise specified. A 50% deposit is required before project commencement. The remaining 50% is due upon project completion and delivery. Late payments incur a 1.5% monthly interest charge. All prices are exclusive of applicable VAT.
2.4 Intellectual Property. Upon receipt of full payment, all intellectual property rights, source code, design files, and digital assets created specifically for the Client are irrevocably transferred to the Client. CreativeBuildWorks retains the right to display completed work in its portfolio unless otherwise agreed in writing.
2.5 Project Timeline. Estimated delivery timelines are provided in the SOW. Delays caused by the Client (e.g., delayed feedback, content provision) may extend the timeline proportionally. CreativeBuildWorks will communicate any delays promptly.
2.6 Limitation of Liability. CreativeBuildWorks' total liability under any project shall not exceed the total fees paid by the Client for that specific project. We are not liable for indirect, incidental, or consequential damages.
2.7 Termination. Either party may terminate this agreement with 14 days' written notice. In the event of termination, the Client is liable for all work completed up to the termination date. Deposits are non-refundable once work has commenced.
2.8 Governing Law. This agreement is governed by the laws of the Federal Republic of Germany. Any disputes shall be resolved in the courts of Dortmund, Germany.
04 SLA & Refund Policy
4.1 Service Level Agreement. CreativeBuildWorks commits to a response SLA of under 2 business hours for all standard inquiries. Urgent dispatches receive a guaranteed 1-hour response during business hours (Mon–Fri, 09:00–18:00 CET). Our platform maintains a 99.9% uptime availability target.
4.2 Support Channels. Support is available via email at [email protected] and by phone at +49 1514 6204819. Urgent dispatches should be submitted through the dedicated Urgent Dispatch form on our contact page.
4.3 Refund Eligibility. As our services are bespoke digital deliverables, refunds are evaluated on a case-by-case basis. The following conditions apply:
- Before work commences: Full deposit refund within 5 business days.
- During the first 20% of project delivery: 75% deposit refund.
- After 20% of project delivery: Deposits are non-refundable.
- Upon project completion: No refunds. All deliverables and IP are transferred upon final payment.
4.4 Refund Process. To request a refund, contact us at [email protected] with your project reference number and reason for the refund request. We will respond within 2 business hours and process approved refunds within 5–10 business days to the original payment method.
4.5 Dispute Resolution. We encourage clients to contact us directly to resolve any concerns before initiating a formal dispute. Most issues can be resolved through our standard support channels. For unresolved disputes, the competent court in Dortmund, Germany shall have jurisdiction.
4.6 Changes to This Policy. CreativeBuildWorks reserves the right to update this SLA and Refund Policy. Material changes will be communicated via email to active clients at least 14 days before taking effect.
